Enacted in October 2005, Dover city code 131-20 blocks sex offenders who must register for life, which includes those convicted of aggravated rape or a host of offenses involving children, from living within 2,500 feet of a school or daycare center, levying a $500 fine for the first violation and a $1,000 fine for a second.
Of course this is a law based on common sense, because rapist and child molesters should NOT live anywhere near a school or daycare center. However, I don’t agree we should have these laws. Not for the same reason that the ACLU do, but because I don’t think a child rapist should be given the mercy of living in society at all. If they are spared death they should be locked away from society for the rest of their lives at a minimum.
In a suit filed in Strafford County Superior Court, the New Hampshire Civil Liberties Union is asking to have Dover’s ordinance invalidated, saying it runs afoul of the state constitution’s due process, double jeopardy and ex post facto protections, as well as state primacy for treating sex offenders.
If the ordinance is struck down in the superior court, it would open the door to legal challenges in the four other communities with similar ordinances. A decision against the ordinance from the state supreme court would effectively nullify all of the sex offender residency restriction ordinances in the state.
Once again the ACLU endanger the innocent with their absolutist and ignorant defense of the perverts. Do they realize what they are doing? I don’t think they really believe in this double jeapordy argument with all their heart. If they do, I challenge them to a community out-reach program we can call, adopt a child rapist. Have an ACLU lawyer adopt one of the perverts they defend to live across the street and roam their children’s playgrounds.
However, the double jeapordy argument is one that could very well work in the court. All the more reason to close this loophole and keep the pervs locked away for good. I’m not talking about an 18 year old getting labled as a child rapist for getting caught with his 17 year old girlfriend though. There are definitely parts of the justice system that need changed and clarified. However, when a 41 year old sexually assaults a fifteen year old girl…he shouldn’t be granted the mercy of living in society.

New Hampshire Civil Liberties Union lawyer Barbara Keshen said the suit is also meant to highlight problems with sex offender residency restrictions, which she says are ineffective.
“I think if these towns studied whether or not these laws were effective in protecting children, they wouldn’t pass them,” she said. “Most of these towns have had a knee-jerk reaction.”
These laws are common sense and it doesn’t take a study to know that the further away a pervert with a record of losing control is from my children, the safer they are from being attacked or assaulted from them. Common sense seems to allude a lot of folks at the ACLU for some reason.

I would sure hope so.
Seriously, now. If you think the penalty from crime X should be Y, make it so. But you absolutely cannot allow individual towns to pile on additional penalties (after sentencing, no less) as they please. That’s pretty repugnant to some longheld legal traditions.
Well Jeff, until we can get those penalties changed I don’t object to local communities taking preventive measures to protect citizens. I think if these criminals are to be released into the public that it should be a part of their punishment that they have restrictions as a condition to that release. That is at a minimum.

How many children need to be raped Jeff before you think it is acceptable for communities to keep child rapists away from children by any means necessary?
Fix the laws first, then damn the sex offenders. Challenges like this will only continue untill the politicians pull their head out. Allowing legislators to enact crappy laws protects no one.

90+% of child molestation takes place between a child and a familiar adult, not the bogey man hiding in the bushes. Where a person lives will not stop a single crime. The incidence of child rape is very rare, but that is what makes headline news. You would punish everyone classified as a sex offender the same as an offender convicted of child rape? It could be your family next…just let your son or grandson sleep with his underage girlfriend and her family presses charges…your loved one is a sex offender for life! This is not Nazi Germany but without immediate changes, it will be soon.
Miss Leah, that “familiar adult” not only likes to rape the nephew for the “regular” daily stand-by, but certainly likes his “strange” as well… thus he is raping the neighbors kid, and the kid in the park, and whomever kid he can get his filthy hands on.
My sons are being raised to know that sex is morally grotesque and illegal with underage partners. If you raise a family with ethics and morals you wont have the concerns you obviously have in your family.
Try to understand these people (sexual predators) deserve no rights as decent humans, they should be completely removed from society for the betterment of society. Find a cure, then we can discuss placing these sick humans in a practice society of only ACLU members and their children, then lets see what happens…
I applaude you, for your work to protect the constitutional rights of these americans.Most readers are uneducated when it comes to the real rammafications of letting our constitution be bent and twisted by our goverment officials.The thing that made the us a free society must be protected even when it seems like the wrong thing to do.It is unfortunate that sex crimes are committed,and even more so when a child is the victim.But people many a man and woman died to protect that precious document,and the people that it was written for.That includes sex offenders,murders,theives,and the entire list of criminals that have been tried convicted and paid their debt to society.We the people have to defend the constitution or continue to allow polititions to destroy it.Thank you to the ACLU,and keep up the good work.
