Here are the facts. He refuses to give ID after leaving and re-entering the terminal, then he’s asked to leave the airport, again he refuses. That’s the basis of his suit. In reality he’s trying to stop the government from using racial profiling to stop terrorists from hijacking airplanes. The ACLU (again) fighting for the right to have terrorists attack us. Such a noble cause….
The top official in charge of fighting racial profiling for the American Civil Liberties Union says he was the victim of profiling at the Boston airport, and he has gone to federal court to challenge a screening technique that relies on suspicious behavior to identify potential terrorists.
King Downing said he was stopped and questioned by state police in October 2003 (4 years ago?-ed) after arriving on a flight to attend a meeting on racial profiling.
Downing sued the Massachusetts Port Authority, which operates the airport, and Massachusetts State Police, alleging they violated his constitutional right against unreasonable search. A trial in the case began Monday in U.S. District Court.
Downing, who is black and wears a short beard, said in his lawsuit that he was stopped by a state trooper and asked to show identification after he left the gate area and made a phone call in the terminal. (sounds like standard procedure to me- ed.)
When he declined, Downing said, he was told to leave the airport, but was then stopped again. He was surrounded by four state troopers and told that he was under arrest for failing to produce identification (how is this profiling? Sounds like he’s an a-hole to me- ed.)

Why is he suing? Because that’s what the ACLU does. It agitates for captured terrorists and tries to make it easier for free range terrorists to get on with their business. This particular case seems to have a few built-in hitches for the ACLU’s master plan.
The do-nothing ACLU won’t be satisfied until every last homeland defense is dismantled. They argue that national security profiling should be based on behavior, not race/ethnicity/nationality/national origin/religion–and then they turn around and sue to stop behavior profiling.

Damn, what a jerk. Man, I wish that someone would start a website keeping track of all the stupid things that the ACLU does. Oh, wait, nevermind.
As usual, the ACLU panders to their own interests and not the interests of U.S. citizens. At some point, I know not when, they will cross the line into clear illegality.
From what I have observed he could have been charged with trespassing after refusing to leave. Requiring an ID before allowing him to board has nothing to do with a search. I can even see the officers getting suspicious when he refused to leave or provide ID and board.

Do you usually have police officers requiring you to show ID when you move about the terminal?
Apparently he did something to alert people’s attention, jerry- and a fair bet that’s exactly what he wanted. And seeing that this happened in a Blue state, I can understand why you might be confused… I’ve been noticing of late that the police in liberal-run states seem to be far more abusive of their power than in Red states.
Otter–that isn’t apparent to me given the facts on the table. You think he wanted to be bugged by the airport police? Is that what you like to do when you’re waiting for your flight? I find it very strange that you condemn Mr. Downing here while absolving the police of any blame. I will make sure not to use bring my cell phone the next time that I take a trip, or better yet, I will make sure not to fit the “normal” profile of a terrorist.
I’d like to know what the ‘normal’ profile of a terrorist is also, since I have several times been picked out to be frisked Twice on the same trip.
btw, 3 of the four police officers were black.
